Non-Financial Misconduct eLearning

Overview

The course provides an introduction to the FCA’s new rules and guidance covering non-financial misconduct (e.g. bullying, harassment and violence) which came into force on 1 September 2026.

In particular, it highlights the potential consequences of NFM under the Conduct Rules, the Fit and Proper Test and general workplace laws and regulations. It also emphasises the importance of the firm’s policies and codes of conduct in relation to such conduct.

Introduction

What is NFM and how does it fit into the regulatory framework?
- Highlights what NFM is and how it fits into the SMCR.

Work-related NFM
- Explains the application of the Individual Conduct Rules to NFM, along with other potential consequences. Specific content is included for SMFs (highlighting the impact of the Senior Manager Conduct Rules).

Personal/private life NFM
- Explains the impact of personal/private life NFM on the Fit and Proper test and internal codes of conduct.

Social media and NFM
- Highlights the circumstances in which social media activity is covered by the Conduct Rules, Fit and Proper test and internal policies.

Conclusion and assessment
- Questions that test understanding of the course content.
